What is the definition of a Tattoo Artist under Florida law?

Tattoo Shops are important businesses that support artists in Miami-Dade and all over Florida. Tattoo artistry is a creative field that is always innovating and creating new artistic expressions for people to enjoy. Tattoo parlors are primarily small businesses that need efficient representation when establishing themselves. Florida defines tattoo artists as the following person(s):
- Persons who tattoo the body of another human.
- Persons who practice cosmetic tattooing, permanent make-up, microblading, or micropigmentation.
- Students/apprentices who tattoo other humans as part of their tattoo training.
Florida tattoo licenses are also required for: Tattoo or permanent makeup artist licensed outside of Florida. Persons licenses outside of Florida may apply for and be registered as guest tattoo artists until they achieve their Florida license and find a tattoo parlor to conduct their work at.
What licenses are required to be legally licensed as a Tattoo Artist?
To legally work as a tattoo artist in Miami and the rest of Florida one must obtain the required licenses as stated under section 381.0075 of the Florida Statutes.
The statute requires that a person looking to be licensed under Florida law complete an application that is sent to their county’s corresponding Department of Health. In order to be licensed in the state of Florida a person must also be of 18 years of age, provide a copy of a government issued ID, and complete the required bloodborne pathogen and communicable diseases course. Those looking to be licensed must meet the minimum score in order to be certified and will include that certification with the application to their county’s Florida Department of Health office.
Following those steps would grant one to be legally licensed as a professional tattoo artist in Florida. Pending the approval of the Florida Department of Health.
What licenses are required to operate a Tattoo Parlor in the state of Florida?
The first step is to complete an application with the corresponding Florida Department of Health for their county. Similar to that of the Tattoo Artist application. For Miami, it would be the Dade Department of Health. Their address is: Environmental Health Section 1725 NW 167th Street Miami Gardens, FL 33056 and their phone number: (305) 623 -3500.
Next, a tattoo parlor or shop must pass inspections. Under Florida the inspections are to be completed in compliance with sections 381.00771 – 381.00791, Florida Statutes, “The Practice of Tattooing” and Chapter 64E-28, Florida Administrative Code. Then, Register business name with the Florida Department of State and contact the appropriate city/county officials for business tax receipt. An important step that is often overlooked is the completion and submission of a biomedical waste permit with the department of health.
Finally, all forms and fees are to be submitted to the County Health Department where the business is going to be located in Florida. Once confirmed, the County Health Department will provide your business with its Florida tattoo license.
